It would depend on the reason for mitigation being beyond your control. If rules within the game are so poorly developed there is no counter for the act of the other player I’d have to go with unfair. If the victim has designed a stripped down list and neglected to include the available tools in their list to deal with the threat I applaud their win getting stomped into the dust.
